Podmínky užití aplikace AisView

AisView Terms of Use and Privacy Policy

1. Úvodní ustanovení

Níže uvedený text je ujednáním, které upravuje podmínky užívání webové verze a mobilní aplikace AisView a všech jejich modulů - AisView, MetView, FRAView, HEMS, Podklady, ASM, UCL a interních modulů ŘLP (dále jen „Aisview“), kterou vlastní a provozuje Řízení letového provozu České republiky, státní podnik (dále jen „provozovatel“), který je v souladu se zákonem č. 121/2000 Sb., o právu autorském, o právech souvisejících s právem autorským a o změně některých zákonů (autorský zákon), ve znění pozdějších předpisů oprávněn vykonávat majetková práva k této aplikaci.

Uživatelem je fyzická či právnická osoba užívající AisView (dále jen „uživatel“).

Používáním aplikace Aisview se uživatel aplikace AisView zavazuje dodržovat tyto Podmínky užití aplikace Aisview (dále jen „Podmínky užití“). V případě porušení Podmínek užití uživatelem může provozovatel uplatnit opatření obsažená v těchto Podmínkách užití.

1. Introductory provisions

The text below is an agreement that regulates the terms of use of the web version and mobile application AisView and all their modules - AisView, MetView, FRAView, HEMS, Podklady, ASM, UCL and internal modules of the ANS (hereinafter referred to as "Aisview"), which is owned and operated by the Air Navigation Services of the Czech Republic, a state enterprise (hereinafter referred to as the "Operator"), which, in accordance with Act No. 121/2000 Coll., on Copyright, on Rights Related to Copyright and on Amendments to Certain Acts (Copyright Act), as amended, is entitled to exercise property rights to this application.

A User is a natural or legal person who uses the AisView (hereinafter referred to as the “user”).

By using the Aisview Application, the AisView User undertakes to comply with these Aisview Terms of Use (hereinafter referred to as the "Terms of Use"). In case of violation of the Terms of Use by the User, the Operator may apply the measures contained in these Terms of Use.

2. Uživatelský účet

Uživatel, který má zájem o využívání registrovaných částí AisView, je povinen vytvořit si uživatelský účet. Vytvoření uživatelského účtu spočívá v zadání uživatelského jména a hesla, vyplnění příslušných osobních údajů, přečtení těchto Podmínek užití a zakliknutí pole „Souhlasím s podmínkami užití“ a „Souhlasím se zpracováním osobních údajů“ umístěného na registrační stránce.

Provozovatel je oprávněn zrušit uživatelský účet, pokud uživatel:

· používá AisView v rozporu s dobrými mravy, právními předpisy a obecně uznávanými etickými a morálními principy a obecně uznávanými pravidly používání služeb poskytovaných prostřednictvím sítě Internet nebo dokonce k páchání či napomáhání trestné činnosti, přestupků či jiných deliktů,

· užívá služby ke komerčním a jiným účelům, které by mohly v konečných důsledcích poškodit provozovatele,

· zneužívá, blokuje, modifikuje či jinak mění jakoukoliv část AisView,

· pokusil se narušit stabilitu, chod nebo data AisView,

· porušuje jiným způsobem práva provozovatele či třetích osob

poskytne své uživatelské jméno a heslo třetí osobě.

2. User Account

A user who is interested in using the registered parts of AisView is obliged to create a user account. Creating a user account consists of entering a username and password, filling in the relevant personal data, reading these Terms of Use and clicking on the fields "I agree to the terms of use" and "I agree with the processing of personal data" located on the registration page.

The Operator is entitled to cancel the User account if the User:

· uses AisView in violation of good morals, legal regulations and generally accepted ethical and moral principles and generally accepted rules of use of services provided over the Internet or even to commit or facilitate crime, misdemeanours or other offenses,

· uses the services for commercial and other purposes that could ultimately harm the operator,

· abuses, blocks, modifies or otherwise alters any part of AisView,

· attempts to disrupt the stability, operation, or data of AisView,

· infringes the rights of the Operator or third parties,

· provides its username and password to a third party.

3. Doba uchovávání údajů

Osobní údaje jsou uchovávány po dobu existence uživatelského účtu a po dobu nezbytnou k naplnění účelů, pro které byly shromážděny.

3. Data Retention

Personal data is retained for the lifetime of the user account and for as long as necessary to fulfill the purposes for which it was collected.

4. Bezpečnost a pravidla ochrany osobních údajů

Osobní údaje poskytnuté uživatelem jsou provozovatelem považovány za důvěrné a budou jím použity pouze pro interní potřebu, zejména pro ochranu oprávněných zájmů provozovatele a dalších subjektů. Osobní údaje nebudou zveřejněny, poskytnuty třetí osobě či jinak zneužity. Při zpracování osobních údajů se provozovatel řídí Nařízením Evropského parlamentu a Rady (EU) 2016/679 o ochraně fyzických osob v souvislosti se zpracováním osobních údajů a o volném pohybu těchto údajů a o zrušení směrnice 95/46/ES (obecné nařízení o ochraně osobních údajů).

Při registraci jsou pořizovány jen údaje nezbytné pro zabezpečení funkce AisView, typy osobních údajů jsou uživatelské jméno, jméno a příjmení, mobilní telefonní číslo a e-mail. Uživatel má možnost zadat i nepovinné údaje jako je organizace a funkce či adresa.

Zpracování vašich osobních údajů provádí Správce, tj. podnik Řízení letového provozu České republiky, státní podnik. Předmětem zpracování jsou osobní údaje vkládané prostřednictvím webového rozhraní nebo mobilní aplikace AisView. Povaha a účel zpracování vašich osobních údajů spočívají ve využívání webové verze nebo mobilní aplikace AisView a všech jejich modulů.

V souvislosti se zpracováním vašich osobních údajů máte následující práva, která můžete uplatnit prostřednictvím e-mailu odeslaného na adresu aisview@ans.cz:

• právo požádat provozovatele o přístup k vašim osobním údajům, jejich opravu, výmaz a případně o omezení zpracování;
• právo vznést námitku proti zpracování vašich osobních údajů;
• právo na přenositelnost vašich osobních údajů;
• právo kdykoliv odvolat udělený souhlas se zpracováním vašich osobních údajů, odvoláním souhlasu však není dotčeno zpracování osobních údajů před jeho odvoláním.

Máte rovněž právo podat stížnost ohledně zpracování vašich osobních údajů k Úřadu pro ochranu osobních údajů (kontaktní e-mail: posta@uoou.cz, nebo datová schránka: qkbaa2n).

Mobilní aplikace AisView požaduje od uživatele povolení oprávnění pro přístup k jeho poloze, které je nezbytné pro správné zobrazení letových prostorů v okolí uživatele. Rovněž je využíváno při plánování letu, i během letu samotného. Poloha zařízení na pozadí je nutná pro správné zaznamenání průběhu letu.

4. Security and Privacy Policy

Personal data provided by the User are considered confidential by the Operator and will be used by the Operator only for internal use, in particular to protect the legitimate interests of the Operator and other entities. Personal data will not be disclosed, provided to a third party or otherwise misused. When processing personal data, the Operator is governed by Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) and Act No. 110/2019 Coll., on the Processing of Personal Data, as amended.

When registering, only the data necessary for the security of the AisView function is collected – username, name and surname, mobile phone number e-mail. User can also fill other optional data such as address or his/her organisation and function.

The processing of your personal data is carried out by the Controller, i.e. Air Navigation Services of the Czech Republic, state enterprise. The subject of the processing consists of personal data entered via the web interface or the AisView mobile application. The nature and purpose of the processing of your personal data consist in the use of the web version or the AisView mobile application and all of their modules.

In connection with the processing of your personal data, you have the following rights, which you may exercise by sending an email to aisview@ans.cz:

• the right to request from the operator access to your personal data, their rectification, erasure, and, where applicable, restriction of processing;

• the right to object to the processing of your personal data;

• the right to the portability of your personal data;

• the right to withdraw your consent to the processing of your personal data at any time; however, the withdrawal of consent shall not affect the lawfulness of the processing carried out prior to such withdrawal.

You also have the right to lodge a complaint regarding the processing of your personal data with the Office for Personal Data Protection (contact email: posta@uoou.cz, or data box ID: qkbaa2n).

AisView mobile app require the user to allow permission to access their location. Location access is necessary for the correct display of flight areas in the user´s vicinity. Positioning is also used in flight planning as well as the flight itself. The position of the device in the background is monitored in order to correctly record the course of the flight.

5. Vymezení odpovědnosti

Provozovatel neposkytuje jakékoliv záruky za zobrazení informací na uživatelském zařízení a za dostupnost aplikace v jakémkoliv čase a místě. Provozovatel však vyvine maximální úsilí pro bezodkladné odstranění nahlášených chyb.

Užití AisView je v plné odpovědností uživatele. Aisview a data v aplikaci obsažená jsou pomůckou pro provedení letu a mají pouze informativní charakter. V žádném případě nenahrazují odpovědnost uživatele/pilota při zjištění všech potřebných informací a provedení letu dle příslušných předpisů. Provozovatel nenese žádnou odpovědnost za případné porušení předpisů nebo škody způsobené uživatelem na základě informací získaných použitím Aisview.

Provozovatel není v žádném ohledu odpovědný za škody vzniklé užitím AisView v rozporu s těmito Podmínkami užití nebo platnými právními předpisy.

Aplikace AisView může uživatele odkázat na internetové stránky třetí strany, přičemž provozovatel není v žádném ohledu odpovědný za obsah, dostupnost nebo jiné aspekty těchto stránek třetí strany. Informace uvedené na těchto stránkách třetí strany nevyjadřují názor provozovatele.

Uživatel odpovídá za své aktivity spojené s užíváním AisView a přihlášením se do Aisview prohlašuje, že nebude AisView používat k žádným aktivitám, které by mohly nebo dokonce jsou v rozporu s právním řádem či zásadami používání služeb poskytovaných prostřednictvím sítě Internet.

Uživatel nesmí obsah AisView ani jeho části kopírovat, distribuovat, upravovat, analyzovat či jinak komerčně využívat.

Uživatel má právo zhotovovat kopie obsahu AisView pro vlastní nekomerční potřebu v rozsahu odpovídajícím této potřebě, zejména formou tisku částí obsahu AisView nebo uložením snímku obrazovky.

Uživatel se dále zavazuje:

· učinit vše proto, aby webové stránky nebyly ohroženy nebo postiženy počítačovými viry,

· neohrožovat bezpečné užívání webových stránek provozovatelem nebo jinými uživateli,

· uvést své skutečné identifikační a osobní údaje, jsou-li provozovatelem vyžadovány

· neposkytnout své uživatelské jméno a heslo jiné osobě.

5. Limitation of Liability

The Operator does not provide any guarantees for the display of information on the user's device and for the availability of the application at any time and place. However, the Operator shall make every effort to remedy the reported errors without delay.

The use of AisView is the full responsibility of the User. Aisview and the data contained in the application are an aid for the execution of the flight and are of an informative nature only. In no case do they replace the responsibility of the User/pilot in finding out all the necessary information and conducting the flight according to the relevant regulations. The Operator is not responsible for any violation of regulations or damage caused by the User based on the information obtained through the use of Aisview.

The Operator shall in no way be liable for damages resulting from the use of AisView in violation of these Terms of Use or applicable law.

AisView may refer the User to a third-party website, and the Operator is in no way responsible for the content, availability or other aspects of such third-party sites. The information provided on this third-party site does not express the opinion of the Operator.

The Users are responsible for their activities related to the use of AisView and by logging in to Aisview declare that they will not use AisView for any activities that could or even are contrary to the law or the principles of using services provided over the Internet.

The User shall not copy, distribute, modify, analyse, or otherwise commercially exploit the content of AisView or any part thereof.

The User is entitled to make copies of the content of AisView for their own non-commercial use, to the extent corresponding to such use, in particular by printing parts of the AisView content or by saving screenshots.

The User further undertakes:

· do everything possible to ensure that the Website is not put at risk or affected by computer viruses,

· not to endanger the safe use of the website by the Operator or the other Users,

· provide their actual identification and personal data, if required by the Operator,

· do not provide your username and password to another person.

6. Meteo data

Zdrojem leteckých meteorologických dat (tj. zpráv METAR/SPECI, předpovědí TAF, informací SIGMET, výstrah) a dalších doplňkových meteorologických dat (obrazové meteoradarové informace, pozorování staničních sítí SYNOP a AKS) je ČHMÚ, který je certifikovaným poskytovatelem letecké meteorologické služby v ČR, a zároveň vlastníkem a vykonavatelem autorských práv k těmto datům.

Veškerá poskytovaná meteorologická data jsou pouze informativního charakteru, v žádném případě nenahrazují standardní meteorologický briefing. Automaticky generovaná meteorologická data (stanice AKS, část pozorování SYNOP, meteoradar) neprocházejí manuální kontrolou kvality a není zaručena jejich dostupnost. Interpretace a případné využití těchto dat je pouze na vlastní odpovědnost uživatele.

Meteorologická data jsou určena výhradně pro potřeby civilního letectví; jiné využívání a/nebo další rozšiřování těchto dat není povoleno.

6. Meteo data

The source of aeronautical meteorological data (i.e. METAR/SPECI reports, TAF, SIGMET, warnings) and other additional meteorological data (meteoradar image information, observations of SYNOP and AKS) is Czech Hydrometeorological Institute, which is a certified provider of aeronautical meteorological services in the Czech Republic, and at the same time the owner and executor of copyright to these data.

All meteorological data are provided for informational purposes only and in no way replace standard meteorological briefings. Automatically generated meteorological data (AKS station, SYNOP observation, meteoradar) do not undergo manual quality control and their availability is not guaranteed. The interpretation and possible use of this data is at the user's own responsibility.

Meteorological data are intended exclusively for the needs of civil aviation; any other use and/or further dissemination of this data is not permitted.

7. Závěrečná ustanovení

Provozovatel je oprávněn kdykoliv změnit tyto Podmínky užití. Účinnost změny nastane okamžikem jejich zveřejnění na webových stránkách, nebude-li na webových stránkách a/nebo v těchto Podmínkách užití výslovně uvedeno jinak.

Veškeré spory vyplývající z těchto Podmínek užití a/nebo z užívání Aisview se řídí českým právním řádem.

7. Final provisions

The Operator is entitled to change these Terms of Use at any time. The change will take effect at the moment of their publication on the website, unless expressly stated otherwise on the website and/or in these Terms of Use.

All disputes arising from these Terms of Use and/or from the use of Aisview shall be governed by Czech law.

8. Technické požadavky

Technické požadavky jsou uvedeny v Helpu aplikace či v App store a Google Play.

Z důvodu snahy o maximální kvalitu služeb poskytovaných prostřednictvím AisView je nutné provádět nepravidelnou údržbu aplikace. Provozovatel dává uživatelům na vědomí, že v době provádění údržby není aplikace dostupná.

8. Technical requirements

Technical requirements are listed in the Application Help or in the App Store and Google Play.

In order to strive for the maximum quality of services provided through AisView, it is necessary to perform irregular maintenance of the application. The Operator informs Users that the application is not available at the time of maintenance.
